Specific Performance is the process through which a buyer of real property forces a sale to completed after a seller refuses to sell the property. The buyer asks the court or arbitrator to exercise its equitable powers to order the seller to convey the property to the buyer.
In order to succeed on a specific performance claim they buyer has to prove certain elements that show that establish the nature of the contract and show that if seller had not refused to perform that the buyer would have been able to uphold his or her end of the purchase and sale contract.
